Warranty/RMA Terms and Conditions

Warranty/Returns
TenX Networks has different policies for these two categories of products:

1- Products that we buy from another manufacturer and then resell the product unmodified and products that we agregate
TenX Networks passes along any warranty guaranteed by the manufacturer. The customer must pay shipping; however, TenX is willing to act as an agent between the customer and the manufacturer. In this case, return the product to Tenx Networks, then we will verify the defect and issue an RMA to the manufacturer. Whether you receive a new product is contingent upon meeting the warranty requirements of the manufacturer. We will keep you updated through the whole process. If the manufacturer denies its warranty to us, then we have no choice but to mail you the defective product back. You are purchasing at your own risk.

2- Products that we manufacture ourselves (our Aeronauts)
Customers may return products purchased from TenX Networks and receive in-house credit up to the amount invoiced for the products subject to the following:
  1. the product fails, is DOA (Dead on Arrival) and returned to us within 15 days of the invoice date
  2. the product is new, unused and resalable
  3. the product is in the original packaging with all packing material, manuals and accessories
  4. the packaging is not altered
  5. the product package is not used as the shipping container
  6. the product can not be a special ordered item, custom tuned, software or custom cable assembly
  7. TenX Networks determines in its sole discretion that the customer is not in default of these Terms and Conditions or any other agreement between the two parties
DOA units must be received back prior to replacements being sent out. Any advanced replacements will be billed as a new sale. Credit will be applied upon return of the defective unit and the defect(s) are verified. Items not returned in compliance with the above conditions are subject to a MINIMUM 25% restocking fee. Customers pay shipping charges to return defective, DOA or failed products to TenX. We will pay shipping if an error in the original shipment was made on our part. Please call for instructions regarding the specific item you need help with or if you have any questions regarding our return policies.

Technical Support and Consulting
Please read and fill out our customer support agreement before contacting us for support.

For a time-based fee, we also offer consulting to help you with your project. Before requesting our services, please fill our consulting engagement agreement.

Qualified Customers
Anyone is eligible to place an order with TenX Networks. Purchasers are classified as resellers, integrators, consultants, service providers, self service end users (consumers), government agencies, health providers and educational.

Payment Terms
New customers will be shipped pre-paid only. We accept payment via wire transfer, or some other form of pre-payment and credit card. International customers must pay in advance via wire transfer or if the order is under $1000.00 USD a copy of your government identification and front and back of your credit card are required. We gladly accept these major credit cards; Visa, MasterCard, and American Express. All products are sold in US Dollars.

Minimum Order Amount
TenX Networks has NO MINIMUM quantity or dollar amount on orders for existing customers. However, a low valued item or quantity may cost you as much to ship as the items are worth.

Pricing
Pricing may change without notice. For information on our tiered pricing structure please contact one of our sales people. Please note that the pricing in our catalog is intended for service providers and resellers, NOT end-users. We are not responsible for typographical errors made by us or listed on a product spec sheet created by the manufacturers we represent.

Inventory
At TenX, we do our best to maintain stock levels on most items in our product offering. If an item is out of stock we will notify you immediately and do our best to advise of an estimated ship date. If you want to buy an item we do not normally stock, or one you do not see on our website we will be happy to special order it for you. Special orders are non-cancelable and non-refundable.

Delivery Schedules
At the time of purchase we will always check current inventory levels and let you know when your order can ship. All parcel shippable orders placed before 4:00 PM Mountain Standard Time (6:00 PM Eastern) usually ship the same day. Express air delivery shipments ordered before 4PM will usually ship the same day. Truck shippable items may take a minimum of 24 hours to process and schedule a pick up.

Backorder Items
As hard as we try, we will not always have everything in stock. If you have placed an order or are looking for a item that we do not have in stock be assured that we will fulfill your request as soon as possible. We will do our best to inform you of manufacture delays and production schedules. Usually we can special order your item immediately from our suppliers.

Shipping Methods
TenX ships all standard orders via United Parcel Service (UPS) ground unless otherwise directed. Shipments to Hawaii and Alaska are normally sent UPS Blue. If you would prefer a specific freight carrier please specify when ordering. Federal Express and DHL are not scheduled pick ups and may cause a delay in order processing. TenX is happy to ship your order via 3rd party collect. We require your billing zip code of your purchase. TenX allows orders to be will called and shipped via a customers 3rd party freight carrier. Please notify us when ordering. ALL required paperwork besides commercial invoices for international shipments is the responsibility of the party ordering product. We are not liable for lost product/shipments will called and/or shipped on 3rd party accounts.

Damage Claims
If an item is damaged during shipping please notify the delivery driver immediately. Orders (both verbal and online) from TenX Networks are not insured unless expressly requested in writing. All items must be inspected at the time of delivery. Any failure to notify TenX of a damaged product within 3 days of receipt forfeits your claim. *IMPORTANT: Even if you suspect damage, write "possible concealed damage" on the freight bill. With this statement you will be able to file a claim should you later discover damage.

Limitation of Liability
DISCLAIMER AND LIMITATION OF LIABILITY: TenX Networks LLC "THE COMPANY" MAKES NO WARRANTIES OF ANY KIND WITH REGARD TO THE PRODUCTS IT DOES NOT MANUFACTURE. THE COMPANY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, AS TO THE PRODUCTS, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL THE COMPANY BE LIABLE FOR ANY LOSS, DAMAGE OR COST OF OR BREACH OF WARRANTY. THE COMPANY WILL NOT, IN ANY EVENT, BE LIABLE FOR ANY LOSS OF REVENUE, PROFIT, USE OF DATA, INTERRUPTION OF BUSINESS OR FOR SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY OR PUNITIVE DAMAGES, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT OF THE USE OF OR INABILITY TO USE THE PRODUCT, OR IN ANY WAY CONNECTED TO THIS AGREEMENT, EVEN IF THE COMPANY HAS BEEN ADVISED OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY WILL APPLY WHETHER ANY CLAIM IS BASED UPON PRICIPLES OF CONTRACT, WARRANTY, NEGLIGENCE OR OTHER TORT, BREACH OF ANY STATUTORY DUTY, PRINCIPLES OF INDEMNITY OR CONTRIBUTION, OR OTHERWISE. IN NO EVENT WILL THE COMPANY'S LIABILITY TO CUSTOMER EXCEED THE PURCHASE PRICE PAID FOR THE PRODUCT THAT IS THE BASIS OF THE CLAIM.
